Dear Miss Deed:
I have a couple of issues involving fee-splitting with another firm that make me think I got the short end of the stick.
I referred a doctor to another firm that stated it had a client who might be interested in my candidate. After the firm received my candidate, they referred my doctor to another firm, which obviously diluted my split. On top of this, I further learned that the original firm to whom I referred my candidate asked the candidate for other doctors he knew (so he could make additional referrals) and did not tell me.
I am angry about this whole sequence of events and want to take…

Dear Action:
At first blush it looks like you did not fare well, but only one aspect of what you experienced violates the Code of Ethics.
The Code states that when a referral is made to another firm for the purpose of splitting a fee, the firm that receives the referral cannot make an additional referral without your permission (with the upcoming revision of the Code of Ethics, that second referral cannot be made without the candidate’s permission as well). So, clearly there is a Code violation here.
By the way, if the second firm involved (the one you did not authorize to receive the candidate) makes a placement, you will need to contact the Arbitration Committee to decide your entitlement and who must pay you.
The second issue involves the firm to whom you made your original referral asking the candidate for other prospective candidates and not sharing those names with you. The Code does allow that firm to ask for and receive names as you had an equal opportunity to “mine” your candidate for other names.
Splitting fees with a firm can sometimes involve risk. The Ethics Committee will help you resolve the first issue, but the second issue, you are on your own.
